The gunsmith from the movie “Rust” has launched an attempt to have her case dismissed after the trial against Alec Baldwin was dropped.
Hannah Gutierrez-Reed was sentenced to 18 months in prison in April after being found guilty in connection with the fatal shooting of cinematographer Halyna Hutchins on the set of “Rust” in 2021.
But after the 66-year-old actress’s manslaughter case was dropped last week because prosecutors failed to disclose all evidence, her lawyer took new steps to secure her release.
Jason Bowles filed an emergency motion with New Mexico courts on Tuesday seeking to have the case against Gutierrez-Reed dismissed or to have the 26-year-old granted a new trial as soon as possible.
Documents obtained by Deadline show he cited “egregious prosecutorial misconduct” and wrote: “Justice demands that Hannah Gutierrez-Reed’s conviction be immediately overturned to ensure that the legal system does not perpetuate this fundamental insult to our system that has been witnessed around the world.”
“The state withheld explosive, exculpatory evidence that it was constitutionally obligated to disclose and that would have led to a fundamentally different trial and likely a different outcome.
“As an alternative to an immediate dismissal or at least a retrial, the court should grant Ms. Gutierrez-Reed’s already filed motion for immediate release pending appeal.”
The filing said more evidence had been “suppressed” than previously known and called for Kari Morrissey to be “removed as special prosecutor because of the identified misconduct and violations committed in the Gutierrez-Reed case.”
However, First District Attorney Mary Carmack-Altwies supported Morrissey’s decision to remain in office.
“There is no better attorney than Kari Morrissey to handle Hannah Gutierrez-Reed’s cases, and her appointment and oath of office still stand,” her office said.
Alec was stunned when Judge Mary Marlowe Sommer dismissed the case on Friday after his legal team argued that prosecutors had withheld evidence related to the cameraman’s death.
